Client terms

Ces conditions sont pour l’instant disponibles en anglais uniquement.
Who we are
Aphelore is run by the Aphelore team (contact: support@aphelore.com). These terms apply when your company uses Aphelore. They are for businesses, and Aphelore is not offered to consumers.
What we do
Aphelore is a marketplace. We check builders, propose them to you, provide the project room and arrange payment through Stripe. Your contract for the work is with the builder you choose. We are not a party to that contract, and we do not supply the work ourselves.
Scope and milestones
The builder writes the scope and milestones. They become binding between you and the builder when you accept them in the project room. Each milestone lasts no more than 60 days.
Payment
You pay each milestone before work on it starts. Stripe processes the payment, and the builder receives it only as described here. The agreed price includes our commission of 15%, which is shown before you pay. Taxes are added where they apply. The builder is responsible for invoicing you for the work.
Acceptance
After delivery you have 7 days to accept the work or raise a problem. If you do neither, the work counts as accepted. The payout is released 14 days after acceptance, and you can still raise a problem during that time.
Problems and refunds
If you raise a problem, the release stops and a person at Aphelore reviews what both sides provide. We then decide to release the payment or refund it, in whole or in part. Our decision settles how the held payment is handled. It does not remove any legal rights you have against the builder.
Handover and ownership
The builder must set up accounts in your name and hand over keys, documentation and workflow exports. Rights in the work made for you pass to you when that work has been paid for in full, except for third-party tools and the builder's pre-existing general tools, which are licensed to you so far as the work needs them.
Warranty
For 60 days after the project ends, the builder fixes defects where the work does not do what the agreed scope says. The warranty does not cover new features, changes by you or others, or changes in third-party tools.
Working through the platform
If you meet a builder through Aphelore, you agree to run paid work with that builder through Aphelore for 12 months after your last project with them or, if you have no project, after you were introduced.
Translated messages
Project messages can be translated automatically so that people can work in different languages. A translation can contain mistakes. The original message is the one that counts, so check important details such as amounts and dates in the original.
Your responsibilities
You must give the builder the access and information needed, test the work, and make sure you have the right to share any data you give them. Where the builder processes personal data for you, you are responsible for having a data processing agreement with them.
Liability
We are liable for our own service, not for the builder's work. Our total liability under these terms in any 12 months is limited to the commission we earned from your projects in that time. Nothing limits liability that the law does not allow us to limit.
Ending and changes
You can close your account once your projects are finished. We may suspend accounts that break these terms. We will give notice of material changes to these terms.
